Terms of Service

You must be at least 18 years of age to use this Service. By creating an account, you represent and warrant that you are 18 or older and have the legal capacity to enter into these Terms.

Access to After Dark (explicit) content requires additional age verification through Stripe Identity. We reserve the right to terminate accounts where age misrepresentation is detected or suspected.

You agree to provide accurate, current, and complete information when creating your account. You are responsible for maintaining the security of your account credentials. You must notify us immediately at support@nocturnefiction.com if you suspect unauthorized access.

You may not create accounts on behalf of others, use automated means to create accounts, or share your account with other individuals.

Due to the digital nature of our Service, all purchases are generally non-refundable once content has been accessed.

Exceptions may be made at our sole discretion in cases of:

• Technical failure that prevented access to purchased content
• Duplicate charges due to billing error
• Unauthorized charges reported within 14 days

Subscription refund requests for the current billing period will be evaluated on a case-by-case basis. To request a refund, contact support@nocturnefiction.com within 7 days of the charge.

If you believe a charge was made in error, you may also contact Stripe directly or file a dispute with your card issuer. We encourage you to contact us first so we can resolve the issue quickly.

You may cancel your subscription at any time through your account settings or by contacting support. Cancellation takes effect at the end of your current billing period — you retain access until that date. We do not prorate partial months.

Cancelling your subscription does not delete your account or conversation history. You may resubscribe at any time and resume where you left off.

The After Dark feature unlocks explicit romantic and sexual content between consenting adult characters. This content is fictional and intended for entertainment purposes only.

• You must be 18+ and complete age verification to access After Dark content
• All depicted characters are fictional adults
• Content depicting minors, non-consensual scenarios presented approvingly, or other illegal content is strictly prohibited and will result in immediate account termination
• After Dark content is for personal use only and may not be redistributed

You agree not to:

• Use the Service to generate content that depicts minors in sexual situations
• Attempt to circumvent authentication, paywalls, or content gates
• Scrape, copy, or redistribute character content, prompts, or AI outputs at scale
• Use the Service to harass, threaten, or harm others
• Impersonate other users or Nocturne AI staff
• Use automated bots or scripts to interact with the Service
• Violate any applicable laws or regulations

Violation of these rules may result in immediate account suspension or termination without refund.

All characters, narrative content, entry flows, and platform design are owned by Nocturne AI LLC or licensed to us. You may not reproduce, redistribute, or create derivative works from our content without written permission.

AI-generated responses produced during your conversations are provided for your personal entertainment only. You do not own the outputs and may not commercialize them.

The Service is provided "as is" without warranties of any kind, express or implied. We do not warrant that the Service will be uninterrupted, error-free, or that AI responses will meet any specific standard. AI characters are fictional — any resemblance to real persons is coincidental.

To the maximum extent permitted by law, Nocturne AI LLC shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service. Our total liability to you for any claim shall not exceed the amount you paid us in the 12 months preceding the claim.

We may update these Terms from time to time. We will notify you of material changes via email or an in-app notice at least 14 days before they take effect. Continued use after changes take effect constitutes acceptance of the updated Terms.

These Terms are governed by the laws of the United States. Any disputes shall be resolved through binding arbitration, except where prohibited by law.
